What is a Trademark?
A trademark is a type of intellectual property that consists of any sign capable of graphical representation and distinguishing a person’s goods or services from others. It may include letters, words, names, signatures, numerals, symbols, brands, headings, labels, tickets, product shapes or packaging, colors, sounds, scents, holograms, positioning, motion sequences, or any combination of these elements.
Who Can Register a Trademark?
Any individual, business entity, institution, or legal organization can apply for trademark registration in Malaysia.
Although registering a trademark is not a legal requirement before using it, it is highly recommended to prevent trademark hijacking and protect your brand.
In Malaysia, the trademark registration process typically takes between 9 to 15 months. The rights associated with the trademark take effect from the date of application submission.

Benefits of Trademark Registration
Registering a trademark provides the owner with exclusive rights to use, license, or sell the mark for the designated goods and services. Additionally, the trademark owner can take legal action under the Trademarks Act 2019 against any unauthorized use or any mark that closely resembles theirs.
What CAN and CANNOT Be Trademarked?

Allowed Trademarks
Under the Malaysian Trademarks Act 2019, the following marks are eligible for registration:

- Marks that contradict any written law.
- Marks that misrepresent the nature, quality, or geographical origin of goods or services.
